1. About These Terms

These Terms and Conditions ("Terms") govern your use of all websites, mobile applications, and services operated by FluxLabs ("we", "us", "our"), including fluxlabs.ink and all apps published under the FluxLabs brand.

By accessing or using any FluxLabs service, you agree to be bound by these Terms. If you do not agree, please do not use our services.

2. Eligibility & Age Requirements

By using FluxLabs services, you confirm that:

• You are at least 14 years old (the age of digital consent in Spain)
• If using Hangover Helper, you are at least 18 years old
• If using Subscription Guardian or any fintech-related features, you are at least 18 years old
• You have the legal capacity to enter into a binding agreement
• If you are under 18, you have obtained parental or guardian consent where required

3. Our Services

FluxLabs provides mobile applications and digital tools including but not limited to:

• Hangover Helper — drink tracking and hydration reminders (18+ only)
• Grocery Budget — personal budget and shopping tracker
• Shift Logger — work hours and earnings calculator
• Menu Costing — food cost and profit margin calculator for hospitality professionals
• Shift Prep — kitchen prep checklist tool
• Flourish — fitness and wellness habit tracker
• Subscription Guardian — personal subscription and finance management tool (18+ only)

We reserve the right to modify, suspend, or discontinue any service at any time with reasonable notice where possible.

4. Accounts & Registration

Some FluxLabs apps require you to create an account. You agree to:

• Provide accurate and truthful information when registering
• Keep your password secure and not share it with others
• Notify us immediately at hello@fluxlabs.ink if you suspect unauthorised access
• Take responsibility for all activity that occurs under your account

We reserve the right to suspend or terminate accounts that violate these Terms or that are used for fraudulent purposes.

5. Payments & Subscriptions

Where FluxLabs apps offer paid features or subscriptions:

Payment Processing

• All payments are processed securely via Stripe
• By making a payment you also agree to Stripe's Terms of Service at stripe.com/legal
• Prices are displayed inclusive of applicable VAT where required by Spanish law

Subscriptions

• Subscription plans auto-renew unless cancelled before the renewal date
• You may cancel at any time through your account settings or by contacting us
• Cancellation takes effect at the end of the current billing period

Refunds

• For app store purchases (Apple App Store / Google Play), refund policies are governed by Apple and Google respectively
• For direct purchases, you have a 14-day right of withdrawal under EU Consumer Rights Directive 2011/83/EU, unless the digital service has been fully performed with your prior consent
• Refund requests should be sent to hello@fluxlabs.ink

6. Affiliate Partnerships

Some FluxLabs apps contain affiliate links and partnerships:

• iSalud — health insurance products may be promoted within Subscription Guardian. We may earn a commission if you purchase through our referral link. This does not affect the price you pay.
• Awin network — we participate in the Awin affiliate network. Partner offers presented within our apps may result in us earning a referral fee.

All affiliate relationships are clearly identified within our apps. We only promote products and services we believe are relevant and beneficial to our users.

7. Acceptable Use

You agree not to use FluxLabs services to:

• Violate any applicable law or regulation
• Attempt to hack, reverse engineer, or compromise our systems or apps
• Upload or transmit any malicious code, viruses, or harmful content
• Impersonate any person or entity
• Scrape, copy, or redistribute our content without permission
• Use our apps for any commercial purpose without our written consent
• Harass, abuse, or harm any other user

Violation of these rules may result in immediate termination of your account and, where appropriate, reporting to relevant authorities.

8. Intellectual Property

All content, branding, code, designs, logos, and materials created by FluxLabs — including the FluxLabs name, logo, and all app content — are the intellectual property of FluxLabs and protected under applicable copyright and trademark law.

You may not copy, reproduce, distribute, or create derivative works from our content without our express written permission.

User-generated content (such as data you input into our apps) remains your property. By using our apps, you grant us a limited licence to store and process that data solely to provide the service to you.

10. Limitation of Liability

To the fullest extent permitted by Spanish and EU law:

• FluxLabs provides its services "as is" without warranties of any kind
• We do not guarantee uninterrupted or error-free operation of our apps
• We are not liable for any indirect, incidental, or consequential damages arising from your use of our services
• Our total liability to you shall not exceed the amount you paid to us in the 12 months preceding the claim

Nothing in these Terms limits liability for death or personal injury caused by our negligence, or for fraud or fraudulent misrepresentation, as prohibited under Spanish law.

11. Third Party Services

Our apps may contain links to or integrations with third party services (including Stripe, iSalud, Awin, Apple App Store, Google Play). We are not responsible for the content, privacy practices, or terms of those third party services. Your use of third party services is governed by their own terms and policies.

12. Termination

You may stop using FluxLabs services at any time and request deletion of your account by contacting hello@fluxlabs.ink.

We may suspend or terminate your access if you breach these Terms, if required by law, or if we discontinue a service. We will provide reasonable notice where possible.

Upon termination, your right to use our services ceases immediately. Provisions of these Terms that by their nature should survive termination (including intellectual property, disclaimers, and limitations of liability) will remain in effect.

13. Changes to These Terms

We may update these Terms from time to time to reflect changes in our services, technology, or applicable law. We will notify you of material changes by updating the date at the top of this page and, where appropriate, by email or in-app notification.

Your continued use of our services after changes take effect constitutes your acceptance of the revised Terms.

14. Governing Law & Disputes

These Terms are governed by and construed in accordance with the laws of Spain and applicable European Union regulations, including but not limited to:

• EU General Data Protection Regulation (GDPR)
• EU Consumer Rights Directive 2011/83/EU
• Spain's E-Commerce Law (LSSI — Ley 34/2002)
• Spain's General Consumer Protection Law (TRLGDCU)

Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the competent courts of Spain. EU consumers also have the right to use the European Commission's Online Dispute Resolution platform at ec.europa.eu/consumers/odr.
